As you can see, there are certain hidden charges associated with filing for Indefinite Leave to Remain (ILR).
We'd like to explain some of the most prevalent for you so you can be financially prepared.
1 Translation of Documents
Any documents that are not in English or Welsh that are critical to the success of your application MUST be translated.
If you do not accomplish this, your application may be denied.
Unfortunately, translating documents will cost you money. And, unfortunately, you cannot translate the documents yourself in order to save money!
So, how much does it cost?
This will be determined by the number of papers that need to be translated.
The usual rule is that you must translate any documents that offer evidence of what you are alleging in order for your application to be granted.
2 English Language Examination
You might have already passed an English Language Test. For instance, when you asked for a visa extension or your first permit to remain.However, this is only applicable if you took the test with a better grade than was previously necessary. If at all possible, we would always advocate this because it saves you money in the long term!
To fulfil the English Language Requirements, you must take and pass a Home Office-approved English Language Test at the B1, B2, C1, or C2 CEFR level.
You can only take tests from the list of Secure English Language Tests.
Typically, you will pay roughly £150. The IELTS Life Skill Test and the Trinity College London Test are both £150.
3 Life in the United Kingdom test
You must also pass the Life in the UK test in order to apply for ILR.
The exam costs £50 to take. If you do not pass the test the first time, you must retake it for a fee of £50.
You should also consider that you may need to take some time off to prepare for the exam. To get ready, you should buy Life in the United Kingdom: a guide for new residents (3rd Edition). This costs between £9.99 and £12.99 and can be purchased here.
4 Legal fees
You may need the assistance of an immigration lawyer to prepare your application. This can cost anywhere between £750 to £3000. (for London based lawyers).
Why is it so pricey? There are several causes for this, which we will discuss further below:
Training – The Immigration Rules for ILR can be complex and time-consuming. We don't know them by heart! Because everyone's circumstances are distinct, they will need to be thoroughly checked with each new instance.
Time - applying for ILR takes a significant amount of time. Checking to see if you meet the requirements, double-checking your documents, filling out the application form, and keeping files/records organised is a time-consuming process.
5 Exceptional Priority Service
If you use the Super Priority Service, you might also pay £610. This means that you will receive a decision the following business day. However, if your application is complicated, it may take even longer.
If your application meets the following criteria, it will be considered complex:
• Your supporting documentation must be checked; • You must attend an interview; and • You have a criminal record.
Your decision will be made within 6 months if you do not employ the Super Priority Service.
6 Prior visas
You will have to pay considerably more if you are not yet ready to apply for ILR. How much you pay will be determined by where you are in your current visa process.
