 A summary of the UK spouse visa requirements

The following are the requirements for a spouse visa:

Relationship – a recognised and ongoing marriage, civil partnership, or evidence of cohabitation for at least two years if applying as unmarried partners;

English language – unless you meet the language requirement by being a national of a majority English-speaking country or graduating from a recognised university where tuition was in English, or unless you are exempt from meeting the requirement – you must take an A1 level (speaking and listening) test.

You must have adequate accommodation in the United Kingdom.

Financial needs – income (£18,600) from specified sources or savings (£62,500) unless exempt;

Some character requirements – the so-called "suitability" requirements;

Intention to make the United Kingdom your permanent residence.

What are the financial requirements for a spouse visa?

To sponsor your spouse or partner, you must have an annual income of at least £18,600 or savings of at least £62,500.

If you have a dependent child who is not a British citizen, the minimum income is £22,400, plus an additional £2400 for the second dependent child and each child after that.

Earnings sources

If you rely on income, it must come from approved sources, such as employment, self-employment, property rental, dividends or investments, or a pension.

If a non-British partner lives outside the UK, their earnings from employment or self-employment are not considered. Their income from property rentals, pensions, and investments, on the other hand, is recognised.

Savings

Savings can be owned by either the British or the non-British partner, or both. They must be kept in a cash account with instant access. You must show that you owned the funds for at least six months, even if they were not in the cash account for the entire six months. For example, if you sold property or assets and rely on the proceeds as your savings, you must trace the assets back six months prior to the application date.

Savings and income combined

It is possible to rely on a combination of savings and income, but the math is complicated. You will need an initial deposit of £16,000 as well as the difference between your income and the shortfall multiplied by 2.5. For example, if the sponsor earns £18,000 per year and the shortfall is £600, the necessary savings are £16000 + £600 x 2.5 = £17500.

Demands for evidence

The required proof of income is strict and depends on the source of income as well as other factors such as the length of your employment or self-employment. Appendix FM SE of the Immigration Rules contains additional information.

Self-employment earnings

Self-employed people must rely on their net income before taxes from the previous fiscal year. Sometimes there is a conflict since the fiscal year was completed lately and the accounts are not yet accessible and not yet requested by HMRC. Immigration regulations, however, cannot be accomplished without the accounts for the previous fiscal year.

If the income from the previous fiscal year is insufficient, the average of the previous two fiscal years can be used.

What are the prices and fees for a spouse visa?

The application fee varies depending on whether the application is submitted from overseas or from the United Kingdom.

The visa price is £1523, the Immigration Health Surcharge is £1872, and priority service is £573 for applications lodged from outside the UK.

If you apply in the UK, the visa price is £1033, the Immigration Health Surcharge is £1560, and super-priority service is £800 if you need a decision within 24 hours.

When may you convert from a 10-year plan to a 5-year plan?

As soon as you satisfy all of the prerequisites, you can move from the 10-year route to the five-year option. You are not need to wait until your visa expires. However, if you have a valid extension of your previous visa, you will have to pay the Immigration Health Surcharge a second time.
